Zocko Marketplace Policy

1. Introduction to Zocko Marketplace

Zocko is a global messaging platform with a built-in Marketplace feature that allows users to buy, sell, and trade both physical and digital goods directly via private messages or group chats. This Marketplace Policy (“Policy”) governs all use of the Marketplace feature and outlines the responsibilities of users, Zocko’s role, and the legal terms users must adhere to when engaging in transactions.

By accessing or using the Marketplace, users agree to comply with this Policy, our Terms of Service, and all applicable laws, including local and international laws governing online transactions.


2. Zocko’s Role and Marketplace Overview

Zocko is a peer-to-peer platform that facilitates direct communication and transactions between buyers and sellers. We provide the platform and tools for users to connect, but we do not participate in transactions, act as a seller, or have control over the goods or services being exchanged.

  • Zocko’s Role: We provide the infrastructure for buyers and sellers to engage, but we are not a party to any transaction.c

  • Seller Responsibility: Sellers are fully responsible for the legality, accuracy, and quality of the products they list for sale.

  • Buyer Responsibility: Buyers must ensure the legality and safety of the products they purchase and complete the transactions in good faith.


3. Prohibited Goods and Services

STRICTLY NO EXCEPTIONS.

Zocko prohibits the sale of the following items in the Marketplace. If a user is found selling, attempting to sell, or offering any of the below items, their account will be suspended or terminated and the illegal listings will be removed immediately.

Prohibited Goods & Services:

  1. Illegal Drugs and Controlled Substances: Including narcotics, stimulants, and any other substances prohibited by law in any jurisdiction.

  2. Counterfeit Goods: Fake or replica branded merchandise or products.

  3. Stolen Property: Items that are stolen or acquired through illegal means.

  4. Weapons and Explosives: Including firearms, knives, explosives, or any other items prohibited under local and international laws.

  5. Hazardous Materials: Dangerous substances that pose a risk to health, safety, or the environment (e.g., toxic chemicals, radioactive materials).

  6. Child Sexual Abuse Material (CSAM): Any content or material that exploits or harms minors, which is strictly prohibited worldwide.

  7. Human Trafficking and Exploitation: Including services or products linked to human trafficking, forced labor, or sexual exploitation.

  8. Pirated Software, Media, and Intellectual Property Infringement: Including pirated digital content, software, music, films, books, and other items that infringe on intellectual property rights.

  9. Unlicensed Gambling or Betting: Any form of gambling or betting that violates the laws of the user’s country.

  10. Items Violating Local Laws: Any goods or services that violate local, national, or international laws, including environmental, trade, or import/export laws.

This list is not exhaustive. Zocko reserves the right to update it at any time based on changing laws and regulations in different regions.


4. Reporting Violations and Enforcement

Zocko is committed to ensuring that the Marketplace remains a safe, legal, and trusted environment. We rely on our community and automated systems to help us detect violations and take appropriate action.

How to Report Violations:

  • Report a Listing: If you encounter a product listing that violates our policies, you can click the “Report” button next to the listing. This will notify Zocko’s moderation team for immediate review.

  • Report a Seller: If you believe a seller is engaging in fraudulent or illegal activity, you can report the seller through their profile or the support page.

  • Report Illegal Content: If you encounter material related to child exploitation, human trafficking, or any other illegal activity, please report it immediately, and Zocko will cooperate with local law enforcement as required.

Investigation and Consequences:

Upon receiving a report, Zocko’s moderation team will:

  • Immediately remove the listing if it violates the Policy.

  • Suspend the seller’s account temporarily or permanently, depending on the severity of the violation.

  • Ban the account from accessing the platform in cases of serious violations.

  • Notify law enforcement or the relevant authorities if the transaction involves illegal activity, particularly involving counterfeit goods, drugs, weapons, or other illicit products.

We may also employ automated systems to scan listings and transactions for illegal activity, ensuring compliance with local and international laws.


5. Payment Systems and Buyer Protection

While Zocko does not handle payments directly, we partner with trusted third-party payment processors (e.g., Stripe, PayPal, etc.) to facilitate secure transactions between buyers and sellers.

  • Escrow System: For high-value items or digital goods, we may implement an escrow system. Payments are held securely until the buyer confirms receipt of the item, ensuring protection for both parties.

  • Buyer Protection: Zocko does not provide direct buyer protection, but users are encouraged to ensure they trust sellers and verify their products before completing the transaction. Users can also report fraudulent or suspicious activity to Zocko.

  • Chargebacks: Zocko is not responsible for chargebacks or payment disputes. Buyers and sellers must resolve disputes directly through the third-party payment processor, but Zocko may mediate in cases of policy violations.


6. User Responsibilities

By using Zocko’s Marketplace, both buyers and sellers agree to the following:

Seller Responsibilities:

  • Accuracy of Listings: Sellers must provide accurate product descriptions, including price, quality, and availability. Misleading listings or false advertising will result in removal from the platform.

  • Compliance with Laws: Sellers must comply with all local, national, and international laws, including intellectual property rights, consumer protection laws, and import/export regulations.

  • Good Faith Transactions: Sellers are responsible for fulfilling their part of the transaction, including shipping the products within the agreed timeframe.

Buyer Responsibilities:

  • Diligence: Buyers must ensure that products they purchase are legitimate, not counterfeit, and comply with their local laws.

  • Dispute Resolution: If issues arise, buyers are encouraged to first reach out to the seller directly for resolution. If issues persist, users may report the issue to Zocko for assistance.

  • Transaction Completion: Buyers are responsible for completing the payment promptly and communicating with sellers if there are any delays or issues with the purchase.


7. Account Suspension and Termination

Zocko reserves the right to suspend or terminate any user account that violates this Marketplace Policy or engages in suspicious, fraudulent, or illegal activity. Reasons for suspension or termination include:

  • Repeated violations of the prohibited goods list.

  • Fraudulent activity such as misrepresenting products, misleading descriptions, or taking payment without sending goods.

  • Failure to comply with Zocko’s Terms of Service or any applicable laws.

Users whose accounts are suspended or terminated will be unable to access the platform.


8. Limitation of Liability

To the fullest extent permitted by law, Zocko is not liable for any damages, losses, or legal issues that arise out of transactions between buyers and sellers. This includes:

  • Disputes between buyers and sellers.

  • Illegal transactions that occur on the platform, including the sale of prohibited goods.

  • Losses or damages resulting from fraud, counterfeit goods, or misrepresentations.

By using the Zocko Marketplace, users agree to indemnify and hold Zocko harmless from any claims, damages, or legal consequences arising out of their use of the platform.


9. Changes to the Marketplace Policy

Zocko reserves the right to amend or update this Marketplace Policy at any time. Any changes will be communicated to users via email or an in-app notification. Users are advised to review this Policy regularly to stay informed of updates.
